The attorney for the borough concert promoter suing a star rapper for $10 million said scheduling conflicts have kept the matter out of court.

Patrick Allocco, CEO of Allgood Entertainment, and his son were detained in Angola for 49 days after rapper Nas didn’t show up for a series of 2012 New Year’s Eveperformances in Luanda, the country’s capital.

A breach-of-contract lawsuit was filed in Manhattan Federal Court in December, Allocco’s New York-based attorney, Bill Meeker, said.

Allocco was held in Angola on fraud charges when Nas and opening act Jeremiah Jai didn’t show up for shows Allocco arranged.

Nas and Jai eventually returned the $300,000 an Angolan promoter paid the rapper through Allocco.

Meeker said he and Nas’ lawyer, Jonathan Davis, were set to have an initial conference April 2, but the sides agreed to ask for an adjournment, which was granted.

The hearing requires Davis and Meeker to participate in a conference call with a judge, but the sides haven’t been able nail down a new date, according to Meeker.

Davis has indicated he plans to ask the judge to dismiss the lawsuit, Meeker said. Davis couldn’t be reached for comment.

In February 2012, Nas told MTV.com Allocco didn’t arrange for the the rapper’s travel visa and return tickets, so he instead flew to Miami and performed at a party hosted by NBA star Lebron James.

“Basically, he was a promoter that I never worked with, and he wanted me to come to Africa for New Year’s, which, for me, I thought, would be the best way to spend New Year’s,” Nas said to MTV.com. “The business wasn’t handled. There was nothing sent to me, and there were no flights. By the time he did send money — he did eventually send money to me — but it was too late to go. I didn’t even have a visa to get in the country. So that’s canceled, the show’s canceled.”

As a result of the ordeal, Allocco said, his son, also named Patrick, suffered frompost-traumatic stress disorder. But the father said his son has since recovered, and is expecting a baby.

In addition to the money he lost, Allocco said, he also still owed concert promoter Henrique “Riquhino” Miguel about $75,000 for profits lost due to Nas’ no-show. He said he also owes the U.S. government money it loaned him to buy plane tickets out of Angola — tickets he wasn’t permitted to use, and couldn’t get refunded.
