Aldon Smith was arrested at 7 a.m. Friday morning on suspicion of DUI after crashing his car in a single-vehicle accidentCSN Bay Area’s Matt Maiocco reported.

The Mercury News reported that Smith also had marijuana and pills in the car at the time of his arrest.

Given that this is Smith’s second DUI arrest since the 49ers selected him in the 2011 draft, he could be hearing from the NFL in the near future, especially the possibility of additional drug charges.

Smith’s first alcohol-related legal incident occurred in January 2012, shortly after the 49ers were eliminated from the playoffs. Later during the 2012 offseason, Smith was stabbed at a party in San Jose. Both Smith and former 49ers teammate Delanie Walker were named in a civil suit by someone who was shot during the same party.

Acccording to NBC Bay Area, Ronndale Esporlas, the plaintiff in that suit, “alleged that he suffered ‘serious, catastrophic and permanent injuries’ when he was caught in a ‘crossfire’ of bullets” during the event. Smith’s lawyer responded to the suit just this week, stating that Esporlas “knew of the dangers and risks” of attending the party, per the Mercury News.

All of Smith’s off-field troubles should give the 49ers reason to be concerned — and the NFL is increasingly likely to step in with some discipline of its own following Smith’s latest arrest. Smith has not yet been punished by the NFL for his past transgressions, but a second DUI may put him in line to be hit with a suspension. Such punishment might not occur until the start of the 2014 season, though the 49ers also could choose to step in and deliver a penalty of their own.

Smith, 23, has 37.0 sacks in two-plus seasons for the 49ers and earned his first Pro Bowl and first-team All-Pro nods in 2012. He has 3.5 sacks so far during the 2013 season.

San Francisco takes on Indianapolis on Sunday. There’s been no indication yet by the 49ers that Smith will be forced to sit out the game.
